Important: Each volunteer must sign the “Release and Waiver of Liability”
before working at a CMI Community Festival site.
Waivers are due July 24, 2011
I, the Volunteer, desire to work as a volunteer for Walnut Street Neighbors Association Dba City of Miracles International and engage in the activities related to being a volunteer for a work project.
I hereby freely and voluntarily, without duress, execute this Waiver under the following terms:
1. Waiver and Release. I, the volunteer, hereby voluntarily releases, discharges, waives and relinquishes any and all actions or causes of action for the personal injury, property damage or wrongful death occurring to it arising as a result of the activities or services which the undersigned may engage in through the volunteer opportunities offered by City of Miracles International
2. Insurance. I, the Volunteer, understand that I expressly waive any such claim for compensation or liability on the part of City of Miracles International beyond what may be offered freely by the representative of City of Miracles International. I also understand that City of Miracles International does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health or disability insurance, in the event injury, illness, death or property damage.
3. Medical Treatment. I hereby release and forever discharge City of Miracles International from any claim whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with an emergency during my time with
City of Miracles International.
4. Assumption of the Risk. I understand that my time with City of Miracles International may include activities that may be hazardous to me, including, but not limited to, construction activities, loading and unloading of heavy equipment and materials, and local transportation to and from the work sites. I hereby expressly and specifically assume the risk of injury or harm in these activities and release City of Miracles International from all liability for injury, illness, death, or property damage resulting from the activities of my time with City of Miracles International.
5. Photographic Release. I grant and convey unto City of Miracles International all right, title, and interest in any and all photographic images and video or audio recordings made by City of Miracles International during my work for City of Miracles International, including, but not
limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings.
IT IS THE INTENTION OF THE UNDERSIGNED BY THIS INSTRUMENT TO EXEMPT AND RELIEVE CITY OF MIRACLES INTERNATIONAL FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE.
The undersigned, for herself or himself, her or his heirs, agents, executors, administrators agrees that in the event that any claim for personal injury, property damage or wrongful death shall be prosecuted against City of Miracles International, the undersigned shall indemnify and save harmless the same from any and all claims or causes of action by whomever or wherever made or presented for personal injuries, property damage or wrongful death.
I also understand that City of Miracles International does not assume any responsibility for or obligation to provide financial assistance or other
assistance, including but not limited to medical, health or disability insurance, in the event injury, illness, death or property damage.
The undersigned agrees to allow City of Miracles International, and sponsors of its events to use his or her name, voice, photo, and likeness for promotional purposes without any cash considerations or payments.
The undersigned acknowledges that she or he has read the foregoing and is fully aware of the legal consequences of signing this instrument.
